As a condition of purchasing and/or utilizing the Eat Like A New Yorker! Dining Pass (Dining Pass), Participant:

1. Hereby releases ATG Network Communications LLC / Food on Foot / Food On Foot Tours / Dining Pass, its officers, directors, owners, and representatives, from all claims, liabilities, obligations, causes of action, or demands that Participant or his/her administrators, executors, heirs, or assigns may have had or may hereafter have or obtain, due to or as a result of any personal injury, bodily harm, or property loss arising from his/her purchase and/or use of the Dining Pass. This includes incidents resulting from the negligence or intentional acts of ATG Network Communications LLC / Food On Foot / Food On Foot Tours / Dining Pass, its officers, directors, owners, and representatives, or the negligence or intentional acts of third parties, including vendors of the Dining Pass.

2. Agrees to indemnify and hold harmless ATG Network Communications LLC / Food On Foot / Food On Foot Tours / Dining Pass, its officers, directors, owners, and representatives from any act committed or omitted by the Participant or others.

3. Is solely responsible for determining which vendors to patronize and which foods to safely ingest, based on any allergies or other personal health issues.

4. Represents that he/she understands that their Dining Pass purchase and utilization is for information and technology purposes only. Any offers made on the Dining Pass are the sole responsibility of the participating vendor making the offer. ATG Network Communications LLC / Food On Foot / Food On Foot Tours / Dining Pass is not responsible or liable in any way for vendors failing to provide their posted offer.

Once purchased, the Dining Pass is strictly non-refundable. The information provided is strictly confidential and will not be shared in any public forum, either online or offline.
